Terms of Use

In providing "Space Business Court" (hereinafter referred to as "the Service") Japan Space Systems (hereinafter referred to as "the Foundation") stipulates the Terms of Service (hereinafter referred to as "the Terms"). In order for users (hereinafter referred to as "users") to use this service, it is necessary to observe these terms.

Article 1 (Scope of the Terms)

  1. The Terms apply to all use of the service by users. In order for users to use the service, they will observe these Terms.
  2. The Foundation considers that the user has agreed to the Terms at the time the user uses the service.
  3. The Foundation will provide individual services to users within the service. Individual services are subject to individual agreements separately from the Terms. In the case where the user uses the individual service, the user shall comply with the individual contracts together with the Terms. In addition, if there is a difference between the terms of the Terms and the terms of the individual agreement, the individual agreement shall prevail.

Article 2 (Change of the Terms)

  1. The Foundation may change the contents of the Terms. In case of changing the Terms, a notice will be give at the prescribed place of the website of the service specified by the Foundation. At the time the user continues to use this service after changing the erms, the Foundation considers the user agreeing to the changed terms after the change.
  2. The Foundation shall not be held liable for any damage caused to the user due to the change of the Terms.

Article 3 (Third party information in the Service)

  1. Information (company information, product or service information, advertisement, etc.) that is provided and provided to users by third parties other than the Foundation in the Service or individual service is referred to as "third party information. Third party information is provided at the responsibility of the third party who requested the Foundation, and the Foundation does not guaranatee anything for the truthfulness, accuracy, up-to-date, usefulness, reliability, legality, etc. of third party information.
  2. When using the service or individual service, the user shall use third party information with his or her own judgment and responsibility. The Foundation shall not bear any responsibility for damage caused to users by the use of third party information by users.

Article 4 (Attribution of Rights)

Ownership, copyrights, intellectual property rights such as patent rights and all other related rights of contents (logo, design, image, text, movie, etc.) used in this service or individual service, belong to the foundation or a third party with legitimate rights. The user shall not copy, transmit, divert, distribute, assign, lend, translate, copy, distribute, transfer, lend, translate, copy, distribute, distribute, assign, lend, translate, adapt or modify such content, regardless of profit or nonprofit, except for prior consent of the Foundation or a third party with legitimate rights.

Article 5 (Matters Prohibited by Users)

    (1) Acts of illegally invading or attempting intrusion into the system or telecommunications equipment of this service or individual service (2) Acts that infringe the intellectual property rights such as copyrights, trademark rights, etc. of the foundation or a third party, privacy, other rights, or acts that may infringe
    (3) An act of dismissing the honor or credit such as slander injury to the foundation or a third party
    (4) Acts that violate various laws or acts that may violate laws and ordinances
    (5) Acts that lead to crime or crime, or actions that may be tied to
    (6) Acts contrary to public order and morals, or acts that are against fear
    (7) Acts of using the information obtained by using this service or individual service for purposes not related to the purpose of the Foundation providing this service or individual service
    (8) Acts that interfere with the use of this service or other users of individual services
    (9) Other Acts that interfere with the management of this service or individual service to the Foundation, or acts that may cause it
  2. If the user falls under any of the items of the preceding paragraph or the Foundation determines that there is a risk of being applicable, the Foundation shall be able to take all measures concerning suspension of use of individual service without giving the user any notice.

Article 6 (Exclusion of Antisocial Forces)

  1. When using this service or individual service, users shall not be or be affiliated with gangsters, gangster members (including sub-constituents), organizations related to organized crime groups, corporate extortionist, social movements, special intelligence violence groups, and other equivalent individuals, corporations, organizations (hereinafter collectively referred to as "anti-social forces").
  2. In using the Service or individual service, users are required to ensure that they do not have any relation with antisocial forces, such as to provide funds to antisocial forces, to provide convenience, or to use antisocial forces for the purpose of unfairly profiting oneself.

Article 7 (Liability for Damages)

If users give damages to the Foundation due to violation of these Terms and Conditions, the users shall pay all damages and expenses (expenses incurred for resolving disputes such as lost profits and attorney fees) to the Foundation.

Article 8 (Interruption of the Service)

  1. The Foundation may suspend the provision of the Service or individual service if it falls under any of the following items.
    (1) When conducting maintenance, construction etc. of a system or telecommunication equipment for providing the Service or individual service
    (2) In the event of a failure in the system or telecommunication equipment for providing the Service or individual service
    (3) If there is a risk of natural disasters, landslides, riots, or other emergencies occur or may occur
  2. In the event of discontinuing the provision of the Service or individual service, the Foundation will inform the users in advance, in a predetermined place of the site of the Service specified by the foundation according to Article 1 of the Terms.
  3. The Foundation shall not be held responsible for any damage caused to the user due to the interruption of this service. However, this shall not apply to cases of intentional or gross negligence of the Foundation.

Article 9 (Change in the Service)

  1. The Foundation may change the contents of the Service or individual service in advance by notifying the user of the contents of the service or individual service at a predetermined place on the website of the Service specified by the Foundation.
  2. The Foundation shall not be held responsible for any damage caused to the user due to the change of the Service or individual service.

Article 10 (Termination of the Service)

  1. The Foundation may terminate the Service or individual service by notifying the user in advance of the termination at a prescribed location of the website of the service specified by the Foundation.
  2. The Foundation assumes no responsibility for damage caused to users due to the termination of the Service or individual service.

Article 11 (Indemnity)

  1. The Foundation shall not engage in any transactions between users and third parties arising from the provision of third party information by the Service or individual service.
  2. In the event that a problem arises between the user and a third party due to the use of the Service or individual service by the user, or if the user gives damage to the third party, the user shall solve the problem at their own risk and the Foundation shall not bear any responsibility.
  3. Regarding the damage caused to the user by the willful or gross negligence of the foundation, the Foundation is liable for compensation only for ordinary losses incurred directly, and the cause is directly attributable to the use of the Service or individual service, and shall not be liable for indirect damages and special damages.

Article 12 (About the handling of personal information)

The handling of personal information obtained from users in this service or individual service shall be based on "Handling of personal information" separately specified by the Foundation.

Article 13 (Governing Law)

The use of the Service, the validity, interpretation and fulfillment of these Terms shall be governed by Japanese law.

Article 14 (Agreed Jurisdiction)

In the event that problems arise between the Foundation and users in using the Service or individual service, the Foundation and users shall consult in good faith and resolve it. In case of litigation concerning the Service or individual service, the Tokyo District Court or the Tokyo Summary Court shall be the first examiner exclusive jurisdictional court.

Article 15 (Supplementary Provisions)

The Terms is enacted from August 1, 2016.
